State prosecutor responds to our administrative complaint with LIES!!! (well maybe I should be politically correct and describe his LIES as Falsehoods) He is declining or dragggging his feet in regards to comply with the request from the Comission on Human Rights for a certtified copy of our criminal complaint against the squatters he is so graciously PROTECTING!
On Friday the 19th of September, two defendants still not arrested were denied a federal Amparo (appeal for dismissal of charges) and now must face the music that is slowlllllyyy winding down to sentencing! Since they elected to NOT present a defense, I don’t see how they can possibly explain their acts of violence caught on TAPE and PHOTOS and witnesss statements as anything but a VIOLENT ACT against peaceful, law abiding property owners trying to build on their legally purchased property! But then again, at the end of the day we are talking about Mexico and not the US justice system. Anything can happen in Mexico.

We go to court on October 6th as we seek protection of the federal court system in ordering the State Prosecutor to issue indictments in our case and to stop protecting the criminals and guarantee us our rights to enjoy our legally purchased property! Should be interesting to see the outcome. If you remember we were denied an amparo to force the executive branch of the Sonoran government to enforce the arrest warrants (it even went to the supreme court for an appeal) they ruled they couldn’t force the state to enforce their own laws (in a nut shell anyway> Either way, nobody has been arrested because of the violent act on February 18, 2006!)
The agrarian court will re-hear our case on the 16th of October because a federal amparo ordered it. They had ruled in our favor on May 7, 2007 but the criminals took exception to that ruling and filed an appeal with the federal court. They prevailed there, but we have to see what happens on Oct 16, 2008. We shall see if the same laws in force on that day are the same laws applied again seeing how the criminals have produced absolutely NO documentation to prove they are the legal owners of our legally purchased property that was issued title by the state of Sonora! They did provide a motion to the criminal courts were they state they have no “personal” inteset in our property! Stay tuned!
Are you sure you want to buy land in Sonora?? They should make a movie about this case or maybe they already have seeing how so many others have been ensnarled with this kind of senario.
Not even the governor has responded to my petition for a written explanation of the legal status of our investment even though the Mexican constituition requires such response in kind. Copy of the formal petition is oposted somewhere on this site or definately on the spanish site (under petition heading)

There are SERIOUS internal irregular problems with the handling of our case by the State Prosecutor (ministerio Publico) that need to be investigated, corrected, resolved and more importantly EXPOSED to the public! more to come on this specific issue with the investigator tomorrow.

The appeals circuit court in Caborca has upheld the lower courts decision to not give us our land back! We are NOT entitled to get our land back! Even though we have CLEAN LEGAL TITLE! Shocking, not really. Remember we are talking about Mexico, where the justice system is like a box of chocolate; you never know what you are going to get!
I really do hope you are paying close attention you investors thinking about buying the American dream south of the border! Take your money and run as fast as you can away from Sonoran Real Estate!

Unfortunately, the Schwarzenegger administration thinks that my situation is not happening the way I presented it because the State of Sonora told them that I have a squatter problem and only a squatter problem. Absolutely no mention of the Molotav Cocktails or the machetes or death threats or the actual physical removal of our trailer of our lands by these criminals.
I am on a mission to have the Schwarzenegger administration remove their rosy colored glasses and actually read my documentation and talk to the Arizona Dept of Real Estate or the Arizona-Mexico Commission or Gov Napolitano’s office or my Lawyer or ….. A wise man once said, Trust; but verify!!!!
I will be directing my attention to the Schwarzenegger administration next week as well and then to President Calderon who will be paying a visit to Hermosillo on the 24th of July 2008. I need to save my pennies becasue full page ads aren’t cheap!

I am trying to fight a system I do not understand, my expectations too high and my patience too low. So I hope to work through this weekend on the new look and hopefully more people will understand what I am trying to accomplish with this blog.
People must know about what can possibly go wrong with their real estate investment. My glasses are no longer rosy colored.
I will however, continue to post documents and photos and hopefully, I can regain control of my blood pressure!
So you think it is safe to invest in Sonoran Real Estate as a foreigner?? Think Mexican law will protect you ??
Keep reading! We just had our land GIVEN away by a local judge!!! It can happen to you too!! Mexican laws don’t even protect Mexicans either!

I am not a lawyer, not in America nor in Mexico. I am a FOOL however for investing in the most beautiful place in Sonora, Mexico. Just another sucker, that got sucked into a nightmare of never-ending proportions!
I have become very versed in the perverse way “things” happen in Sonora. This dream has been an expensive endeavor and mind-boggling adventure with the highest levels of frustration and disgust one can imagine.
It is my intent with this blog to share my experiences with future naive American Investors that believe they too can buy the American Dream south of the border. It is not my intent to offer any legal advice, just to educate the masses or as many people I can possibly reach of the potential pitfalls that are associated with investing in Mexico, particularly in the State of Sonora. Our experiences include being threatened with death, machetes, Molotov Cocktails and being educated by high up officials from the Bours administration that our problem is “Social” in nature and NOT a “legal problem!”
Additional and a more distressing situation was when I tried to file criminal charges with the district attorney, I was told, “you are a GRINGO ILLEGALLY in Mexico, you can not sue any Mexican on Mexican soil without the proper visas!”
I would like to take the effort to publicly acknowledge and thank those few government employees of the State of Sonora that have been more than helpful in my search for righting wrongs and correcting injustices! These people have gone well above and beyond my expectations in terms of helping this frustrated “gringo” get his due justice in a not so “just” Sonora. Like I had previously stated, this Blog is not an indictment for the entire Sonoran system, just the rotten part of it that has thrown so many obstacles and barriers to punishing those terrorists that attacked us and threw us off our land and now won’t let us get it back!
For those of you have inquired, we are not the only investors that are in this proverbial sinking ship, there are several fellow Americans fighting the same fight we are. We are by far, the furthest along in our battle. One American investor even had his police protection detail along with his workers thrown off their land by a mob lead by a POLITICIAN!!!! How is that for corruption? How many people went to jail for that? NONE! But the American investor got SUED for taking down the squatters make-shift fencing!!!!

This picture was taken the day the we were physically thrown off our land and the police were ordered to leave the scene and not protect our property. The officer pointing at the camera was physically pushed and kicked off our property by the woman in black and the man (I believe her husband) on the left. She is the daughter in law to the man in the blue-green t-shirt that attacked our people with Molotov cocktails and the main in the red hat is one of the leaders that threatened us with arson and machetes if we did not abandon our property. Both men are wanted under the arrest warrants that have not and will not be executed.
